Terms & Conditions – 2020 Snap, Tag and Win! #wolfburgersg @gongchasg Instagram contest

1. Terms and Conditions:

1.1 Entry into the promotion is deemed acceptance of these terms and conditions.

1.2 Clause headings are inserted for convenience of reference only and shall not affect the interpretation of the terms and conditions.

1.3 The promoter is Howlers Pte Ltd (201533641N), 8 Marina View, Asia Square Tower 1 #02-15 Singapore 018967 (the “Promoter”).

2. Duration

2.1 The promotion period commences at 5pm (GMT+8) on 11 May 2020 and ends 11:59pm (GMT+8) on 7 June 2020 (the “Promotion Period”).

2.2 The promotion period is divided into four (4) qualifying weeks as follows:

a) Week 1: 11 May, 5pm to 17 May 2020, 11:59pm

b) Week 2: 18 May, 5pm to 24 May 2020, 11:59pm

c) Week 3: 25 May, 5pm to 31 May 2020, 11:59pm

d) Week 4: 1 June, 5pm to 7 June 2020, 11:59pm

3. Eligibility to enter

Entry is open to citizens and permanent residents of Singapore, excluding directors, management, employees, and their immediate families of the Promoter and its related bodies corporate, who are 18 years or older and have a Facebook account (the “Eligible Entrants”).

4. Entry into the promotion

4.1 To enter, the Eligible Entrants must during the Promotion Period:

a) Follow @burgersbywolf and @gongchasgofficial Instagram page

b) Post a picture of you enjoying at least one (1) WOLF Burger and one (1) Gong Cha Bubbletea

c) Hashtag #wolfburgersg and #gongchasg in the same post

4.2 The Promoter is not responsible for any lost, late or misdirected entries.

4.3 Eligible Entrants are eligible to win one (1) prize only.

4.4 The time of entry will be deemed to be the time the entry is received by the Promoter.

4.5 The Promoter reserves the right, at any time to verify the validity of entries by the Eligible Entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5. The prize

5.1 Each qualifying week, the entry with the most number of likes will win $30 Wolf Burgers & Gong Cha vouchers. (the “Prize”). Total four (4) winners.

5.2 Amongst the four (4) winners, the entry with the most number of likes during their entry week will receive a $200 WOLF Burgers and Gong Cha voucher.

5.3 Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter. By accepting the prize, the winners agree to the conditions of its use.

5.4 If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.

5.5 The Promoter reserves the right to refuse prizes to any winners after the specified prize collection period.

6. Judging of entries

6.1 Entries will be tabulated based on the stipulated qualifying week.

6.2. At the end of each qualifying week (17 May 11:59pm, 24 May 11:59pm, 31 May 11:59pm, 7 June 11:59pm), the entry with the most number of likes will be selected as the winner of that qualifying week. Total four (4 winners)

6.3 Judging Criteria: Participants must:

a) Follow @burgersbywolf and @gongchasgofficial Instagram page

b) Post a picture of you enjoying at least one (1) WOLF Burger and one (1) Gong Cha Bubbletea

c) Hashtag #wolfburgersg and #gongchasg in the same post

6.4 Tabulation of the number of likes for each winner will be recorded at the closing of qualifying week for their participating entry.

6.5 Out of the four (4) winners, the winner with the most number of likes recorded during the closing of qualifying week for their participating entry, will win an additional $200 WOLF Burgers & Gong Cha vouchers.

6.6 Only entries that are complete and appropriate, as deemed by the Promoter, will be eligible.

6.4 The judges’ decision is final and no correspondence will be entered into.

7. Notification of the winner

The winners will be notified via Instagram private message and their names will be published on the Promoter’s Instagram Stories on 18 May, 25May, 1 June and 8 June 2020. The final winner will be notified on 8 June 2020. All winners are required to acknowledge the Promoter’s message by 15 June 2020, 11:59 pm (GMT+8).

8. Backup entries

8.1 As part of the selection process, the Judges will select an additional two (2) entries as backup winners in the event that any entrant(s) is unable to satisfy the promotion terms and conditions; forfeits or does not claim a prize.

8.2 For any winners who fail to acknowledge the Promoter’s email message by the required period, the Promoter will award those prize(s) to the backup winner(s) in the order decided by the Judges, subject to any written direction given under applicable law. Any replacement winners determined in accordance with this clause will be notified via Instagram private message on 21 June 2020.

9. Limitation of liability and variation of terms

9.1 If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure or delay in performing its obligations. The Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.

9.2 The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (the “Promotion Parties”) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the publicity of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (“Damages”) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.

9.3 The exclusion of liability in clauses 9.1 and 9.2 do not apply to limit or exclude liability:

(i) For personal injury or death suffered or sustained in connection with the supply of goods or services, which are supplied by the Promoter in the ordinary course of business. In avoidance of doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; and the Promoter’s Conditions of Carriage and general booking conditions and any exclusions contained therein apply despite any statement to the contrary in these terms and conditions; or

(ii) To the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).

10. Entry details and privacy

10.1 Entry details remain the property of the Promoter. The name and photographs of the winners and all recipients of the prize may be used for promotional purposes by the Promoter and its partners, unless the winners otherwise notify the Promoter at the time of accepting the prize. Entrants consent to the Promoter and its partners using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes (including to any applicable statutory authorities) and to conduct marketing activities. Without limiting the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement.

11. Tax Implications

The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.

12. Important information and conditions about competitions on Facebook

12.1 This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Eligible Entrants understand and agree that they are providing their information to the Promoter and its partners and not to Facebook. By entering this competition, each Eligible Entrant releases Facebook from any action or claim arising out of the competition. Any questions, comments or complaints regarding this competition must be directed to the Promoter, not Facebook.
